What we do

The Virtual School works in partnership with the child or young person's social worker and school/educational setting to ensure that they are supported to fulfil their potential at all stages of their education, and to give them the best opportunity to be successful in their adult lives.

The purposes we use your personal information for

We collect and process your personal information to provide these services to you. This will include:

  • carrying out our statutory duties pertaining to children and young people in care where this applies
  • monitoring the education and support for children and young people in care
  • providing educational advice to make positive changes in the individuals education
  • to investigate any worries or complaints you may have about your education or our services
  • to check the quality of our services.

The personal information we collect and use

We only obtain and use the information we need to provide our services to you. We also obtain and use special category information.

The law we use to process your personal information

Statutory legislation:

The main legislation that provides us with the statutory basis to deliver our services is:

  • The Children Act 1989
  • The Children Act 2004
  • The Children and Families Act 2014.

The condition that we use to process your personal information is:

  • Legal obligation: the processing is necessary for us to comply with the law (not including contractual obligations).

Special category personal information - We also use these additional conditions to process your special category personal information

  • Public interest: the processing is necessary for reasons of substantial public interest
    • statutory etc. and government purposes - the exercise of a function conferred on a person by an enactment or rule of law (statutory functions)
    • equality of opportunity or treatment - necessary for the purposes of identifying or keeping under review the existence or absence of equality of opportunity or treatment between groups of people specified in relation to that category with a view to enabling such equality to be promoted or maintained
    • support for individuals with a particular disability or medical condition
    • safeguarding of children and of individuals at risk
    • safeguarding of economic well-being of certain individuals.

  • BCP Children’s Social Care Services
  • BCP Quality and Commissioning services
  • BCP Finance services
  • Department for Education
  • Schools and Academy trusts involved on the education of the child
  • Welfare Call Ltd who provide us with data collection and analysis services
  • A range of ‘Alternative provision’ suppliers who provide us with bespoke educational services such as tutoring, counselling and other educational activities.

How long we keep information about you

We will retain this information for the ‘life of the child’ equal to 95 years from the date of birth of the child as stated in our statutory guidance and as required by the Independent Inquiry into Child Abuse (IICSA).
