Antisocial Behaviour Case Review

The ASB Case Review allows victims of antisocial behaviour (ASB) to request a review of their case if they believe that agencies have taken no action or not done enough to help. The ASB Case Review is about how agencies have responded to a complaint of ASB. The Antisocial Behaviour, Crime and Policing Act 2014 introduced a process to give victims the right to request a review of their reports of anti-social behaviour and bring agencies together to take a joined-up, problem-solving approach to review their case and look for new solutions.

The Dorset ASB Case Review Procedure sets out how victims of anti-social behaviour across Dorset can request a review of their ASB case.

The ASB Case Review is not a substitute or alternative to a formal complaints procedure and all agencies have processes in place to deal with a formal complaint about a given service. Contact your lead agency or contact us for advice.

Who can use the ASB Case Review

Any Dorset based resident, community or business may use the ASB Case Review to request a review of their case. The community may be a loose group of affected residents, a formal community group or residents association, or just a few affected people in a street. An individual acting on behalf of a group must have all other individual’s consent in order to raise the ASB Case Review on their behalf. An advocate such as a support worker, MP or family can apply on behalf of an affected person but will need their consent to do so.

Thresholds and qualifying complaints

To activate a ASB Case Review a qualifying complaint must have been made to one of the relevant bodies, as set out in the Dorset ASB Case Review Procedure as follows:

  • there must have been 3 reports from one person regarding 3 separate incidents of antisocial behaviour reported to any local agency within a 6 month period
  • each incident must have been reported to at least one of the relevant bodies within one month of the incident occurring
  • the first reported incident must be within 6 months of applying for a case review under the Community Trigger procedure
  • the behaviour complained of must be classified as anti-social behaviour capable of achieving the threshold described in the Dorset ASB Case Review Procedure

A Qualifying Complaint can be either a closed ASB case or still be under investigation to any agency in Dorset. This includes ourselves, Dorset Council, Dorset Police or a social housing landlord such as a housing association.

The procedure sets out the process that will be followed and the contact the application can expect throughout the ASB Case Review process.

The ASB Case Review

If the application is a qualifying complaint for a case review, a multi-agency partnership meeting will be held to review:

  • how the ASB case has been handled
  • what actions have been taken
  • how effective these actions have been
  • what else the partners can do to tackle the ASB and support the victim

At the meeting an action plan will be drafted and shared with the victim.

To request a review of your ASB case please complete the ASB Case Review application form and email it to asbteam@bcpcouncil.gov.uk.

It is vital we have all the information requested on the application form to allow us to assess the application.

Where a victim has a language or literacy issue, or a disability we will accept applications in person or by telephone. However, a signed consent on the official application must be obtained.

The Anti-social Behaviour, Crime and Policing Act 2014 requires publication of the statistical data in relation to ASB Case reviews requested in a local government area. Please note the figures from 2014 - 2019 are amalgamated from legacy Bournemouth, Poole and Christchurch Councils. 2020 onwards is for BCP Council.
